Online Poker Laws in Spain

The regulation of poker in land-based rooms is dependent on regional laws. But concerning online poker and according to the Spanish Gaming Act, this form is regulated by the Directorate General for the Regulation of Gambling. This way, having a federal license allows operators to offer the game all across the country.  Poker falls under the definition of “other games”, which “correspond to all games (...), such as, for example, poker or roulette, in which there is a component of randomness or luck and those in which sums of money or financially assessable items are risked”. In this way, operators have to apply for a general license, but also for a specific one to offer poker.  The tax rate for online poker operators is 20% of the gross gaming revenue. Moreover, gamblers also have to declare their winnings in their Personal Income Tax return.  This licensing system has enriched the poker scene, as many operators such as PokerStars or Party Poker are providing their services in the country. However, because licensed websites can only offer their services to Spanish citizens, players are still trying to access unlicensed platforms where they can play tournaments against people from all around the world.

In order to keep competing in the market, operators need to make sure that their platforms are running safely. This means that they only accept transparent and reliable payment methods.
