Although there are no specific Indian casino laws and the Government doesn’t specifically ban online casinos in India, it is still considered to be mostly illegal in the country to operate and to access these websites. Even though Nagaland has only legalized online gambling in the context of games of skill, Sikkim passed the Sikkim Online Gaming (Regulation) Amendment Act, 2009, which legalizes all forms of online gambling. Operators may apply for a license, which is valid for a year and can be renewed. As of 2019, no other state has released legislation on the matter.  Moreover, there are many Indian gamblers playing in international casino sites, as the ITA doesn’t cover individual players participating in online gambling and despite the Public Gambling Act from 1867, there have been no reports of prosecuted gamblers in India.
